Paul Sanderford served as the featured speaker at the Construction Financial Management Association, Austin – Central Texas Chapter March 2014 meeting. Calvin Cowan Wins Restricted Appeal Reversing Default Judgment

March 2014 – The Texas Sixth Court of Appeals (Texarkana) reversed and remanded a no-answer default judgment granted by a District Court in Tyler, Texas against a general contractor. The appellate court unanimously agreed that the subcontractor claimant failed to exercise reasonable diligence in serving the lawsuit upon the general contractor’s registered agent before resorting to substitute service upon the Texas Secretary of State.

Calvin Cowan Wins Summary Judgment Defending General Contractor

September 2012

Calvin Cowan obtained summary judgment in defense of a general contractor against a banking institution seeking more than $150,000.00 in economic damages. The bank alleged the client “converted” property belonging to a subcontractor that the bank claimed as collateral. In its order granting summary judgment, the court agreed that the bank had not produced a scintilla of evidence to support its damage claim.

Calvin Cowan Obtains Favorable Judgment for General Contractor

In July 2012 Calvin Cowan obtained a favorable judgment for a general contractor against an owner following a week long non-jury trial where the owner refused payment under a cost-plus agreement. The owner contended that payment was excused because the contract price exceeded the project budget.
