On behalf of the American Subcontractors Association, Shaina M. H. Swanson, Allen Wilson and Brian Carroll submitted an Amicus Brief to the Texas Supreme Court regarding the matter of Third Coast Services, LLC & SpawGlass Civil Construction, Inc. v. Castaneda. The Texas Supreme Court ruled that direct contract (privity) with the Texas Department of Transportation (TxDOT) is not necessary for immunity under Texas Civil Practice and Remedies Code Section 97.002. The Texas Supreme Court’s ruling reversed a lower court decision holding that only the prime contractor was entitled to immunity.

Calvin Cowan Wins Judgment in Favor of General Contractor Against Owner

On December 17, 2025, Calvin Cowan secured a take nothing judgment for a general contractor against an owner along with a money judgment and foreclosure of a mechanic’s lien following a three day trial to the court. The owner sued the general contractor alleging damages for overpayment and breach of contract. The general contractor prevailed in its counterclaims for breach of contract and lien foreclosure.

After a two-week arbitration that ended on April 4, 2025, Thomas J. Walthall, Jr. and Victoria McDaniel-Sonnier secured an award of $2,436,755.88 in damages on behalf of a boutique hotel owner against four trade contractors and successfully defeated all affirmative claims of more than $2,600,000.00 against the owner.

Calvin Cowan Secures Judgment in Favor of Client

On November 15, 2024, Calvin L. Cowan secured a $144,936.00 judgment in favor of his client, a building contractor, against an owner. The final judgment awarded full damages, including attorney’s fees, prompt payment act interest, costs of court, foreclosure of a constitutional lien, and sale of a commercial property. On February 27, 2025, Mr. Cowan prevailed against the defendant’s attempts to obtain a new trial.

Brian Carroll served as a public member of the Texas Real Estate Commission where he was elected secretary to the Texas Real Estate Inspector Committee. In addition, Brian served as chair to the Inspector Standards of Practice Subcommittee. His term ended on December 31, 2024.
